Acceptance of Terms

BY ACCESSING AND USING THE SERVICES IN ANY MANNER, YOU ARE "ACCEPTING" AND AGREEING TO BE BOUND BY THESE TERMS OF SERVICE TO THE EXCLUSION OF ALL OTHER TERMS. If you do not unconditionally accept these terms in their entirety, you shall not (and shall have no right to) access or use the Services. If the terms of this Agreement are considered an offer, acceptance is expressly limited to such terms.
Wherever used in these Terms of Service, “you”, “your”, “Customer”, or similar terms mean the person or legal entity accessing or using the Services. If you are accessing and using the Services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms of Service.
We reserve the right, at any time, to update and change any or all of these Terms of Service, in our sole discretion, including but not limited to the fees and charges associated with the use of the Services. If we do so, we will post the modified Terms of Service on our website (the “Site”), though we will notify you of any changes that, in our sole discretion, materially impact these Terms of Service.

Definitions

• Authorized Users means individuals who are directly accessing the Services via an online sign-up process, or individual users authorized by you to use the Services and who you have supplied user identifications and passwords to.
• Customer Content means all information and data (including text, images, photos, videos, audio, and documents) or any other content in any media and format provided or made available to ZIK Analytics by or on your behalf in relation to the use of the Services.
• Services means services provided to you by ZIK Analytics based on the plan you have purchased.
• Third-Party Services means products, services, applications, or websites made available by third parties through the Services.

ZIK Analytics Services

During the Term, subject to the terms and conditions of this Agreement, and solely for your personal or internal business purposes, ZIK Analytics grants you and your Authorized Users a right to access and use our Services for the number of Services purchased, and support, if applicable, in accordance with the plan you selected.

Payment Policy

Monthly and Annual plans: ZIK Analytics operates a 7 days $1 trial for Monthly and Annual plans. If you do not cancel your trial before the 7-day period ends, ZIK Analytics will automatically charge you for a subscription on a monthly or annual basis, depending on the option you chose during signup. If you do not wish to be charged after your 7-day trial has expired, you must cancel your automated payments before the trial ends. No refunds will be given if you fail to cancel your subscription during the trial period.
Lifetime plans: Lifetime plans do not include the 7-day trial period but come with a 14-day money-back guarantee. To claim back your payment, you will need to contact our Customer Support.

Updates and Functionalities

You acknowledge that from time to time ZIK Analytics may apply updates to the Services and that such updates may result in changes in the appearance and/or functionality of the Services. ZIK Analytics shall provide, implement, configure, install, support, and maintain at its own cost any and all updates.

Acceptable Use

You shall be responsible for your and your Authorized Users’ compliance with these Terms of Service. You must not make the Services available to anyone other than your Authorized Users, attempt to reverse engineer the Services, or use the Services to store or transmit any content that may be infringing, defamatory, or otherwise unlawful.

Fair Use Policy

ZIK Analytics may suspend your access to the Services for abusive practices that degrade the performance of the Services for you and/or other customers.

Third-Party Products and Services

You acknowledge that the Services may enable you to access Third-Party Products and Services, and you agree that your use of such Third-Party Products and Services is at your own risk.

Intellectual Property

ZIK Analytics retains all right, title, and interest in and to the Services. You may provide feedback to ZIK Analytics, but such feedback will not create any confidentiality obligation for ZIK Analytics.

Term and Termination

Term of the Agreement: The term shall commence on the day you first use the Services and continue until your subscription ends or your account is canceled. Termination: ZIK Analytics can terminate or suspend your access to the Services at our sole discretion for any violation of this Agreement.
Effects of Termination: Upon termination, you will cease all use of the Services and pay any unpaid amounts owed to ZIK Analytics.

Warranty Disclaimer

ZIK Analytics provides the Services on an “as is” and “as available” basis and expressly disclaims all warranties, whether express or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose.

Indemnification

You shall defend, indemnify, and hold harmless ZIK Analytics from any claims, damages, or costs arising out of your use of the Services or any Third-Party Products and Services.

Limitation of Liability

• ZIK Analytics will not be liable for any indirect, special, incidental, or consequential damages arising out of or related to this Agreement or the Services provided.

General

This Agreement is governed by the laws of the Republic of Cyprus, without regard to its conflict of law provisions.

This Agreement constitutes the entire agreement between the parties regarding the use of the Services and supersedes any prior agreements.
Your Additional Indemnification: You shall also indemnify ZIK Analytics against claims related to your use of the Services or any Third-Party Products and Services.
Data Exchange: You consent to the exchange of data between the Services and Third-Party Products and Services.
